Welcome to PDFProFlow.com (“we”, “us”, “our”). These Terms govern your use of our website (“website” is www.pdfproflow.com) and services that allow users to upload and convert PDF files into other formats (the “Service”). By accessing or using the Service or website, you agree to these Terms in full. If you do not agree, please do not use the Service or website.

TERMS OF USE

1. Use of the Service
1.1. You may use the Service to upload PDF files and convert them into formats such as DOCX, XLSX, or others we offer.
1.2. You must not use the Service for unlawful purposes, to distribute malicious files, or to infringe the intellectual property, privacy, or other rights of others.
1.3. You are responsible for ensuring files you upload do not contain illegal, confidential, or harmful content and that you have all necessary rights/permissions.
1.4. We may suspend or terminate access if we reasonably believe misuse has occurred or to protect the Service and other users.

2. Accounts and Subscriptions
2.1. You may use basic conversions anonymously and free of charge.
2.2. Advanced features are available to registered users with a paid monthly subscription.
2.3. Account information must be accurate and kept updated by you.
2.4. Subscriptions renew automatically unless cancelled in your account before the next billing cycle.
2.5. We may modify plans or pricing with reasonable notice. If you do not agree to changes, you must cancel before they take effect.

3. Uploaded Files and Data Handling
3.1. Uploaded files are processed solely to deliver conversions you request.
3.2. All uploaded files and converted outputs are permanently deleted from our servers after the conversion process completes.
3.3. We do not use uploaded files for training, marketing, or analytics.
3.4. Internet transmission is inherently insecure; while we use reasonable safeguards, we cannot guarantee absolute security.
3.5. You must retain your own backups; we are not an archive or records-retention service.

4. Use of Third-Party Services
4.1. We may utilise third-party APIs or service providers for conversions, hosting, payment processing, or support functions.
4.2. Such providers act as processors under our instruction and are bound by appropriate confidentiality and data protection obligations.
4.3. We are not responsible for the availability, performance, or outputs of third-party services outside our reasonable control.

5. Intellectual Property
5.1. Site content, design and code are owned by or licensed to us and protected by law.
5.2. You retain ownership of files you upload. You grant us a temporary, limited licence to process those files solely to provide the Service.

6. Termination
6.1. We may suspend or terminate access to the Service immediately if you breach these Terms or where reasonably necessary to protect the Service, users, or comply with law.
6.2. Upon termination, rights granted to you under these Terms cease. Sections that by their nature should survive (including Privacy, Disclaimer & Limitation) will continue in effect.

7. Changes to These Terms
7.1. We may revise these Terms or our Privacy Policy at any time. Updates will be posted on this page with a new “Last updated” date. Continued use after changes take effect constitutes acceptance of the revised terms.

8. Governing Law & Jurisdiction
8.1. These Terms and any disputes arising out of them or the Service are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer forum rights that cannot be waived.

PRIVACY POLICY (INCLUDING GDPR COMPLIANCE)

1. Data Controller
PDFProFlow.com (operating from England) is the data controller for personal data processed via the Service.

2. Data We Process
(a) Technical/operational data (e.g., IP address, logs);
(b) Account and payment details for subscribers (payment card details are processed by our payment provider - we do not store full card numbers);
(c) Uploaded files (temporarily, for conversion only).

3. Purposes of Processing
To provide and improve the Service, operate accounts and subscriptions, process payments, ensure compliance with law and detect or prevent misuse.

4. Retention
Uploaded files are deleted after conversion. Account data is kept while your account is active and as legally required thereafter; you may request deletion of non-required data.

5. Your Rights (UK GDPR)
You may request access, rectification, erasure, restriction, objection and portability. Exercise rights via our contact form. We will respond within one month, subject to lawful extensions.

6. Legal Bases
Processing is based on consent (for optional features), contract (to provide the Service) and legal obligations (e.g., tax/records).

7. Security
We implement appropriate technical and organisational measures; no method is 100% secure.

8. International Transfers
Where processors are outside the UK, we rely on appropriate safeguards (e.g., IDTA/SCCs or adequacy decisions).

9. Cookies & Tracking
We do not currently use tracking cookies or analytics tools. If this changes, we will provide notice and obtain consent where required.

10. Complaints & Contact
For privacy or data-related questions, contact us via the contact form. If unsatisfied, you may lodge a complaint with the Information Commissioner’s Office (ICO).

DISCLAIMER & LIMITATION OF LIABILITY

1. No Warranties; “As Is”. The Service (including, but not limited to any conversions, outputs, formats, metadata, fonts, layout, formulas, embedded media, macros, accessibility tags and translations) is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties to the maximum extent permitted by law, including satisfactory quality, fitness for a particular purpose, non-infringement and any arising from course of dealing or usage of trade.

2. No Reliance; Output Verification. Conversions may be imperfect or incomplete. You are solely responsible for reviewing outputs and ensuring they meet your needs before using, sharing, or relying on them.

3. Explicit Consent to Third-Party Processing & Transmission. By uploading or submitting any file, you expressly and irrevocably authorise us to transmit, route, store, cache, scan and process your files through third-party infrastructure and service providers (including but not limited to conversion APIs, hosting, networking/CDNs, storage, logging, security and payment processors), which may be located inside or outside the UK. You acknowledge that your files and related data may be processed by such third parties solely to provide and support the Service. To the maximum extent permitted by law, we accept no liability for any access, disclosure, use, loss, corruption, alteration, or unavailability of your files arising from or relating to third-party services or networks, even if caused by the acts, omissions, negligence, failure, or breach of such third parties. Our obligations are limited to exercising reasonable care in selecting and instructing processors and implementing appropriate technical and organisational measures as described in our Privacy Policy.

4. Sensitive or Confidential Content; Public Disclosure Risk Assumed by You. This clause is essential. You must not upload any content whose disclosure could cause harm to you or others (including but not limited to trade secrets; privileged, confidential, or proprietary information; personal data; special-category data; payment card data; authentication credentials; health records; government IDs; or private communications), unless you have (a) fully anonymised/redacted it, or (b) you knowingly and voluntarily accept all risks of disclosure. You acknowledge and agree that, despite reasonable safeguards, the internet and third-party systems are inherently vulnerable and that disclosure could occur due to error, misconfiguration, defect, downtime, cyber-attack, data breach, or human mistake by us or any third party. By continuing to use the Service and by submitting any file, you expressly accept and assume these risks and agree that, to the fullest extent permitted by law, there shall be no liability on PDFProFlow.com for any resulting loss, damage, or harm, whether direct or indirect, including where disclosure is caused by us or a third party. If you cannot accept this allocation of risk, do not use the Service.

5. Exclusions of Damages. To the maximum extent permitted by law, we will not be liable in any way for any of the items included in this non-exhaustive list (a) loss of profits, revenue, business, contracts, opportunity, goodwill, or anticipated savings; (b) loss, corruption, inaccuracy, or unrecoverability of data or files; (c) costs of substitute goods or services; (d) downtime, business interruption, or delays; (e) special, indirect, incidental, exemplary, or consequential damages; or (f) loss resulting from unauthorised access to or alteration of transmissions, accounts, or data.

6. Cap on Liability. Subject to non-excludable rights, our total aggregate liability to you is limited to the lower of: (a) the total fees you paid to us in the twelve (12) months immediately preceding the event; or (b) £100. For free users, you agree our aggregate liability is £0.

7. No Responsibility for User Content. We do not control or assume responsibility for files you upload. You are solely responsible for the legality, accuracy and appropriateness of your files and for obtaining all necessary consents and permissions. If you send something, it is on you.

8. No Responsibility for Use on a Public Device. Do not use on a device which is publicly available, shared by other users or not your own. We have no control over publicly accessible devices (for example, but not limited to, library computers, shared mobile devices, school compters). If you use our Service and/or website via a computer or other device which is publicly accessible or shared in any way with other users, we will not be held responsible for any data you upload becoming available to other people. If you upload something from a device you do not own, or a device which is shared by other users, you create increased risk of your information becoming publicly available. DO NOT UPLOAD ANYTHING FROM A DEVICE YOU DO NOT OWN OR ANY DEVICE WHICH IS SHARED BY OTHER USERS.

9. Allocation of Risk; Acceptance by Use. The exclusions, disclaimers and limits in this Section reflect the agreed allocation of risk and are fundamental to the price and availability of the Service. By accessing the Service, uploading any file, clicking “convert”, or otherwise continuing to use the Service, you confirm that you have read, understood and expressly accept this Disclaimer & Limitation of Liability. If you do not accept, do not use the Service.
